Türkiye Legal Update - July 2023

The Constitutional Court annulled the rules as to five-year service requirement and the avoidance of a portion less than six months' annual service in calculating the severance payment under the Press Labour Law.

Constitutional Court ruled that expecting applicants who do not know the reasoning of the decision to apply for appeal as of the announcement of the judgment before receiving the reasoned decision violates the right to access to the court.

Considering the upward trend in patent litigation arising from SEPs,  SEP has become patent law’s new buzzword and Turkey may soon become one of the jurisdictions to handle SEP litigations.

Having an opposition accepted on the basis of one of the arguments and no further appeal to the rejection of other arguments filed by the opponent, it becomes questionable whether the rejected arguments can be raised at the litigation stage.
